Portland Public Schools' superintendent, top lawyer, others broke ...

Eight employees of Portland Public Schools, including Superintendent Carole Smith and the district's top lawyer, broke state election laws by using the public office to sway voters to vote for a huge school construction bond earlier this year, a state investigator concluded.

The officials all had a hand in writing, editing or approving fliers, emails and web site postings that the state concluded were biased in favor of the $548 million bond or which omitted the bond's likely full costs to taxpayers.? The state's compliance investigator, Carla Corbin, reached that conclusion after consulting with lawyers and other officlals at the state Department of Justice and the Secretary of State's office, where she works.

The bond, the largest local government bond ever on the Portland ballot, was narrowly defeated, garnering a 49.8 percent "yes" vote.

Five of the the eight school district workers found to have broken state law are top-ranking district leaders whose salaries exceed $110,000 a year.

In addition to Smith, they are general counsel Jollee Patterson, chief financial officer CJ Sylvester, executive director of community involvement and public affairs Robb Cowie, and executive director of school modernization Sarah Schoening.

The Oregonian reported in April on the many ways in which district employees appeared to have broken the law by using biased language and images to cull voter sympathy for the bond and occasionally omitting or minimizing information about the potential costs to taxpayers.

Three other employees also were found to have broken the law, including former public affairs director Sarah Carlin Ames, public information officer Matt Shelby and family communications manager Katie Essick. Carlin Ames has since taken a top communications job in the governor's office. Three additional employees who played a strictly clerical role in getting the information to the public were cleared.

Under state law, the eight employees found to have violated the law can request a hearing to show why they should be cleared. If they do not within 20 days, each must pay a $75 fine.

Shelby, speaking on behalf of all eight employees, said they plan to request hearings.

"We are disappointed in the finding," he said. The investigation conducted so far was much like a yes-or-no checklist that gave the employees little opportunity to make their case, he said.

"Throughout the process, we took strides to follow, to the best of our ability, the guidelines set forth," he said.

In her report, Corbin wrote that problems with materials the district sent to parents and voters and posted on its web site included using non-neutral wording such as "need" and "critical," omitting information about the potential costs to homeowners, using "enthusiasic and emotional" language and timing publications to arrive just before the election.

This is not the first time the state elections agency found top Portland Public Schools officials broke elections law. In 2005, then-Superintendent Vicki Phillips and her acting communications chief each paid a $175 fine after the state concluded a back-to-school letter sent to every district family was illegally biased against a ballot proposal to kill a county income tax for schools.

Chinese general's spy talk leaked onto YouTube

(AP) ? Footage of a Chinese general discussing sensitive spying cases has been leaked onto Google Inc.'s video sharing site YouTube, in what appears to be an embarrassing failure of secrecy for the usually tightlipped military.

It wasn't clear when or where Maj. Gen. Jin Yinan made the comments and China's Defense Ministry did not immediately respond Monday to faxed questions about the video. Calls to the National Defense University where Jin is a lecturer rang unanswered.

While some of the cases had been announced before, few details had been released, while others involving the military had been entirely secret.

Among those Jin discussed was that of former Ambassador to South Korea Li Bin, who was sentenced to seven years for corruption. Jin said Li had actually been discovered passing secrets to South Korea that compromised China's position in North Korean nuclear disarmament talks, but the allegations were too embarrassing to make public and graft charges were brought instead.

"In all the world, what nation's ambassador serves as another country's spy?" Jin said.

Similar treatment was handed out to the former head of China's nuclear power program, Kang Rixin, who was sentenced to life in prison last November on charges of corruption. Jin said Kang had in fact peddled secrets about China's civilian nuclear program to a foreign nation that he did not identify, but that was considered too sensitive to bring up in court.

Kang, a member of the ruling Communist Party's powerful Central Committee as well as its disciplinary arm, was one of the highest-ranking officials ever to be involved in spying, Jin said. His arrest dealt a major shock to the party leadership, Jin said.

"The party center was extremely nervous. They ordered top-to-bottom inspections and spared no individual," he said.

Jin also talked about Tong Daning, an official from China's social security fund, who was executed in 2006 after being convicted on charges of spying for rival Taiwan. Jin said Tong had passed information to the island's leaders about China's currency regime, allowing them to avoid massive losses due to exchange rate changes.

Among the cases involving military personnel, Jin said that of Col. Xu Junping, who defected to the United States in 2000, did not involve the loss of any technical secrets.

Instead, Xu relayed to the Americans his knowledge of the military leaderships' personalities, attitudes and habits gleaned from many years accompanying the top brass on trips abroad, Jin said.

The video was also posted on Chinese websites, and while it was removed from most locations, screen shots, audio files and transcripts of Jin's comments could still be found on sites such as Sina Weibo's popular microblogging service.

Jin's presentation, complete with explanatory slides, was typical of how such cases are discussed at private sessions as a warning to Communist Party cadres not to be lured into espionage or corruption. The leaked video appeared to have been from an official recording rather than filmed by a member of the audience.

Authorities heavily police the Chinese Internet but can only remove objectionable content after it is posted and have no control over what appears elsewhere.

While Chinese are enthusiastic users of social media, YouTube and Facebook are blocked inside China and their Chinese equivalents are required to inspect all content and remove politically sensitive material before being ordered to do so.

Atrocities and lack of supplies strain Tripoli (VIDEO)

In Tripoli, human rights workers and locals are uncovering evidence of mass killings by Muammar Qaddafi's retreating army. Meanwhile, water distribution and other basic services are in disarray.

After a week of fierce fighting between Libyan rebels and loyalists in Tripoli that sealed the ouster of strongman Muammar Qaddafi, a sense of normality is beginning to return to the city?s streets.

But many challenges remain, posing an immediate test of the interim government's ability to rule a restless country after 42 years of brutal, capricious leadership. Leaders in the National Transitional Council (NTC) and its local Tripoli branch face scrutiny both from international organizations as well as citizens facing shortages of water, fuel, and electricity.

Evidence is beginning to emerge of atrocities committed in the heat of the fighting, with Human Rights Watch reporting more than 100 arbitrary executions of detainees, medical workers, and others throughout the capital. While journalists and human rights workers are still investigating the atrocities, the New York-based organization said it suspected the Qaddafi regime.

?The evidence we have been able to gather so far strongly suggests that Gaddafi government forces went on a spate of arbitrary killing as Tripoli was falling,? said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch.

At a roundabout south of Bab al-Aziziya, Qaddafi?s sprawling compound in central Tripoli, more than 30 corpses were found in and around what looked like a makeshift field hospital.

They wore the green wristbands of Qaddafi loyalists, although the wristbands looked suspiciously new compared with the state of their clothing, and at least some of them appeared to have been executed.

At the nearby Abu Salim hospital, more than 100 bodies were discovered on Friday. On an upper floor at least two Qaddafi soldiers had clearly been executed while lying in their hospital beds. But claims that Abu Salim constituted a massacre perpetrated by the victorious rebels need further investigation.

?Some of them came in here alive, others were already dead. Some were Qaddafi soldiers, but some were rebels, too,? says Naima Al Maghribi, the head of the hospital?s cleaning crew, as she leaned on a mop and tried to clean up the facility.

One explanation, repeated by several hospital staff members, was that the Abu Salim hospital became a morgue for fighters from both sides as well as civilians killed in the fight for the capital.

There was another grim scene in the Sallaheddine neighborhood, where at least 45 bodies were discovered in a charred hangar near a barracks belonging to the Khamis Brigade, named after one of Qaddafi?s sons and sometimes referred to as the 32nd Brigade.

Syrian army strikes in town near Turkish border

Syrian forces stormed a town on the main road leading to Turkey on Sunday after troops loyal to President Bashar al-Assad fought a night-time battle in Damascus with army defectors who had refused to shoot at a pro-democracy protest.

Six months into a popular uprising, Assad is under pressure from street protests and from Arab foreign ministers who told Syria on Sunday to work to end bloodshed "before it is too late."

The Arab League decided to send its secretary-general to Damascus to push for reforms, while the president of neighboring Turkey said he had lost confidence in Syria.

Residents of Khan Sheikhoun, on the main road 245 km (155 miles) north of Damascus, said two people had been killed in an army assault on their town. Two local activists, Tareq al-Nisr and Musaab Taha, were wounded, another activist said.

"It was an assassination attempt. The security police and shabbiha (militiamen) are beginning to use targeted assassinations and arresting people in larger numbers," said the activist, who gave his name as Abu Wael.

In Damascus, dozens of soldiers defected and fled into al-Ghouta, an area of farmland, after pro-Assad forces fired at a large crowd of demonstrators near the suburb of Harasta to prevent them from marching on the center, residents said.

"The army has been firing heavy machine guns throughout the night at al-Ghouta and they were being met with response from smaller rifles," a resident of Harasta told Reuters by phone.

A statement published on the Internet by the Free Officers, a group that says it represents defectors, said "large defections" occurred in Harasta and security forces and shabbiha loyal to Assad were chasing the defectors.

It was the first reported defection around the capital, where Assad's core forces are based.

Syrian authorities have repeatedly denied any army defections have been taking place. They have expelled independent media since the uprising against Assad, from Syria's minority Alawite sect, erupted in March.

Activists have been reporting increasing defections among the rank-and-file army, mostly drawn from Syria's Sunni majority but dominated by an Alawite officer core effectively under the command of Assad's brother Maher.

In the town of Hirak in the southern Hauran Plain, a crowd shouted, "Oppressor, your reign will finish. Prepare yourself for execution," according to a footage distributed by residents.

In the eastern town of Albu Kamal on the border with Iraq's Sunni heartland, which has been besieged by tanks for weeks after large protests, an activist said security police snipers fired at protesters who streamed out of a main mosque after nightly Ramadan prayers, injuring five people.

The United Nations says 2,200 people have been killed since Assad sent in tanks and troops to crush months of street demonstrations calling for an end to his family's 41-year rule.

Syrian authorities have blamed armed "terrorist groups" for the bloodshed across Syria and say 500 police and army have been killed.

The latest demonstrations in Damascus were triggered in part by an attack Saturday by Assad's forces on a popular cleric, Osama al-Rifai. He was treated with several stitches to his head after they stormed al-Rifai mosque complex in the Kfar Sousa district of the capital, home to the secret police headquarters, to prevent a protest from coming out of the mosque.

Protesters have been buoyed by increasing international condemnation of Assad's crackdown. President Abdullah Gul of Turkey, a former ally, said the situation had reached a point where changes would be too little too late, Turkish state-run news agency Anatolian reported.

Gul told Anatolian in an interview: "We are really very sad. Incidents are said to be 'finished' and then another 17 people are dead. How many will it be today? Clearly we have reached a point where anything would be too little too late. We have lost our confidence."

In Cairo, the Arab League said in a statement after an extraordinary meeting that it was concerned "over the dangerous developments on the Syrian arena that had caused thousands of casualties" and "stresses the importance of ending bloodshed and to resort to reason before it is too late."

It was the first official Arab League meeting on Syria since the start of the uprising, inspired by revolutions in Tunisia and Egypt that sparked unrest across the Middle East and North Africa. The foreign ministers said Syria's stability was crucial for the Arab world and the whole region.

Assad's closest ally, Shi'ite Iran, with which he has been strengthening ties to the disquiet of Syria's Sunni majority, has said Damascus must listen to the "legitimate demands" of its people.

Iran warned NATO Sunday against any temptation to intervene in Syria, saying that rather than the defeating a regime it would be bogged down in a "quagmire" similar to Iraq or Afghanistan.

The storm may affect over 10 million people and surely many animals. During such chaos, animal guardians are often unsure as how best to care for their pets. Others refuse to evacuate if they cannot bring their pets along. However, not evacuating may put you and your beloved pet into harm?s way. Here are some tips on how to keep you and your pets safe during the hurricane season.

If Hurricane Irene has not reached your area yet, here are a few tips to help you keep tabs on your pet and help him fight off disease.

How To Prep Your Pet For Disaster
  • Make sure your pet has received necessary vaccinations
  • Attach an identification tag to your pet?s collar
  • Have your pet microchipped
  • Make sure people know a pet is in the house. Making signs indicating the number and types of pets present cues your neighbors to call for help and notifies rescue teams to save your pets should you be out when an emergency occurs.

Now that your pet has been microchipped and vaccinated, here is a list of supplies you should have packed and ready to go just in case disaster hits.

  • Check beforehand to see if your storm shelter will lodge pets. ? In natural disasters, we are often flustered by the chaos. While we wouldn?t think twice about bringing our pet with us to a storm shelter, some shelters do not allow animals. So, check to see if the storm shelter in your area will allow your pet. If the shelter cannot accommodate your pet, try checking different disaster shelters, motels, hotels, and the homes of your family and friends who are safe from the disaster to see where you can safely sojourn with your pet. Also be prepared to board your pet ? your pet?s information you already prepared will come in handy here.
  • Do not leave your pet alone. ? During such an emergency, we cannot be certain of the duration or the magnitude of the natural disaster. Therefore, bring your pets with as they face the same dangers you would by staying home. Pets left at home can be injured by debris and face possible starvation and dehydration. In short, if you need to evacuate, bring your pet too.
  • Keep your pets indoors and ready to leave. ? If required to evacuate your home, you will not want to be frantically searching for your pet. Thus, dogs should be leashed and cats in carriers in order to make an easy evacuation.

While you will be more than ready to return home and let your pet roam free, do not immediately give your pet free reign of the house.

After The Disaster

When the disaster clears and you can return home, do not let your pet run free as dangerous objects and debris may be strewn both inside and outside your home. Your pet may also become disoriented or stressed if the disaster completely disheveled your home.

HP Stops Selling and Supporting Their ... - Business PR News

At a Chamber of Commerce function yesterday, word was going around that HP tablets were all sold out everywhere at $99.? The reason, I was told by those who knew more about it, is that HP has stopped selling and supporting their consumer products. ?They're moving their focus to business products, like IBM did 6 years ago. ?For more information, see the news below. ?

Based on what these news links are telling us, this will happen in stages. ?HP's tablet just came out not too long ago and at $99, were sold out everywhere, including on the?HP website. ? Their PC products will eventually be sold to another company under a different brand name, according to these news links below.

This is a blow to many people who just bought their laptops and the brand new HP tablet at full price and to retailers who bought a shipload of their consumer products before the news came out.

The fatherhood effect | A Voice for Men

When I was younger, at the beginning of the relationship with my first wife, I had the occasion to babysit for a family member and was accompanied by my partner. The child a girl about 5 at the time seemed to be edgy and clingy after her parents had left. I decided it might be comforting for her to sit and draw pictures. She quietly insisted on our presence and participation. Clearly she wasn?t comfortable alone and was looking for attention.

We continued to draw and I decided to attempt an experiment with her that focused on archetypal symbols. I asked her to draw a house, a tree, a river, the sun and a snake. Some may know what the symbols represent. If you don?t, no big deal. It doesn?t really matter. Let?s say symbols and characters can often represent people or things, our relationship to them and how we may be feeling about them.

The process I use is to simply note the detail of each symbol and ask questions. If you?re clever you can use this exercise to introduce positive reasoning skills to address feelings of discomfort. For example if the tree represented the father and it has many branches and no leaves, it may represent a father that is unavailable and often busy. Questions help. Is it autumn? Wow that tree has to work really hard to get enough water out of the ground to make leaves for shade. I?m sure the reader gets the point.

I?d like to note if you?re not comfortable with communicating this way, don?t. Not everyone is comfortable with abstract conversation and it?s easy to misinterpret what is being communicated. My personal opinion is this can help with talking to kids, primarily because they provide the subject matter with their art. My rule of thumb is to never allow my reaction or response to be equal to or stronger than theirs. If it is you may be coercing them to confuse their own feelings with yours. It?s disrespectful to treat a child this way. All I can say is ? don?t. I take a passive role, ask questions, suggest abstract alternatives to abstract statements and listen. They know what they mean. I don?t.

In the experiment I was conducting, the most unusual detail was the snake was drawn in the river and the river was drawn with waves. I wondered about this and asked questions.

?Yes, the water is very fast, the baby snake can?t swim very well.?

?Oh that?s a baby snake swimming??

All at once she jumped into my arms sobbing and said. ?The mommy and daddy snake are swimming to fast and the baby snake can?t keep up, the baby is going to get lost.?

Needless to say, I got the drift, held her tight and let her cry. Once she finished, I asked if she felt better. She said she did and I said that I thought the baby snake was a pretty good swimmer and knew when to ask for help. I realized the isolation she felt and gave it some thought. I concluded that she was unable to find a way or did not know how to express what she was feeling and may not have even understood her own feelings of isolation. I have carried that experience with me for years, always with an eye to test the insight and try to change it.

How will a child understand the concept of honesty if it is only solicited on demand and never freely exchanged?

They don?t need to be right and they particularly don?t need to be wrong. They do need to be valued. Your honesty and willingness to exchange allows them to conceptualize and express. In that process they learn how to respect a meaningful dialogue. If you say to a child, I feel sad, the people at work are not very nice to me and I don?t know what to do, it becomes an open door to problem solve and a process they can use as a template to serve themselves in similar conditions. They will learn to ask questions pertinent to the problem and develop those skills. Or we can teach them to pathologize their feelings and medicate.

Once you have interest you have conversation and communication. Too often kids become decorations in our life, they are the decoration of our ability to control our lives, the evidence of our conformity. Sit still, behave, listen, don?t touch that, I said no, stop fidgeting, put that away.

Children are terribly isolated from a very common human experience. The playfulness of conversation that we exchange between adults can be had with children if you can respect their boundaries. We have a physical bond by proximity and affection but we offer them no freedom to express their thoughtfulness. We regiment their performance but we exclude their experience and their freedom to express it. We love them, but only enough to maintain our sense of control and safety, enough for them to conform to our fears.

We all wish for our children to be safe but we only give them a narrow bandwidth to communicate. How could they possibly learn to identify a predator if they are unable to discern deception? ?How could they possibly say no when we constantly require and coerce them to obey? ?We teach them to be afraid, but we don?t give them skills to overcome their fears.

Diet that combines cholesterol-lowering foods results in greater decrease in LDL than low-saturated fat diet, study finds

ScienceDaily (Aug. 23, 2011) ? Persons with high cholesterol who received counseling regarding a diet that combined cholesterol-lowering foods such as soy protein, nuts and plant sterols over 6 months experienced a greater reduction in their low-density lipoprotein cholesterol (LDL-C) levels than individuals who received advice on a low-saturated fat diet, according to a study in the August 24/31 issue of JAMA.

Efforts have been made to improve the ability of conventional dietary therapy to reduce serum cholesterol through the inclusion of specific foods or food components with known cholesterol-lowering properties, singly or in combination (dietary portfolio), according to background information in the article. The long-term effect of such diets compared with conventional dietary advice has not previously been assessed.

David J. A. Jenkins, M.D., of St. Michael's Hospital and the University of Toronto, and colleagues conducted a multi-center trial to determine whether advice to eat a dietary portfolio consisting of foods recognized by the U.S. Food and Drug Administration as associated with lowering serum cholesterol achieved significantly greater percentage decreases in LDL-C levels compared with a control diet at 6-month follow-up. The control diet emphasized high fiber and whole grains but lacked components of the portfolio diet, which emphasized dietary incorporation of plant sterols, soy protein, viscous fibers, and nuts. The study included 351 participants with hyperlipidemia from 4 participating academic centers across Canada (Quebec City, Toronto, Winnipeg, and Vancouver) randomized between June 2007 and February 2009 to 1 of 3 treatments.

Participants received dietary advice for 6 months on either the low-saturated fat therapeutic diet (control) or a routine or intensive dietary portfolio, for which counseling was delivered at different frequencies. Routine dietary portfolio involved 2 clinic visits over 6 months and intensive dietary portfolio involved 7 clinic visits over 6 months.

In the modified intention-to-treat analysis of 345 participants, the overall attrition rate was not significantly different between treatments (18 percent for intensive dietary portfolio, 23 percent for routine dietary portfolio, and 26 percent for control).

The researchers found that the change in LDL-C levels from the beginning of the study to week 24 in the control diet were -3.0 percent or -8 mg/dL. In the routine and intensive dietary portfolio interventions, the respective percentage changes were -13.1 percent or -24 mg/dL and -13.8 percent or -26 mg/dL for LDL-C levels.

"Percentage LDL-C reductions for each dietary portfolio were significantly more than the control diet. The 2 dietary portfolio interventions did not differ significantly. Among participants randomized to one of the dietary portfolio interventions, percentage reduction in LDL-C on the dietary portfolio was associated with dietary adherence," the authors write.

"In conclusion, this study indicated the potential value of using recognized cholesterol-lowering foods in combination. We believe this approach has clinical application. A meaningful 13 percent LDL-C reduction can be obtained after only 2 clinic visits of approximately 60-and 40-minute sessions. The limited 3 percent LDL-C reduction observed in the conventional diet is likely to reflect the adequacy of the baseline diet and therefore suggests that larger absolute reductions in LDL-C may be observed when the dietary portfolio is prescribed to patients with diets more reflective of the general population," the authors write.

NFL's Haynesworth pleads no contest in fondling case (Reuters)

WASHINGTON (Reuters) ? Former Washington Redskins football player Albert Haynesworth pleaded no contest on Monday to an assault charge for fondling a female server at a hotel bar in February, federal prosecutors said.

The plea included a deferred sentencing deal that called for the 30-year-old Haynesworth to perform 160 hours of community service and undergo counseling as directed.

He also must obey all laws and court orders over the next 18 months, refrain from engaging in any assaultive, threatening, harassing or stalking behavior and stay away from the server, prosecutors said.

The New England Patriots late last month agreed to a trade with the Redskins for the disgruntled defensive lineman, who had previously played for the Tennessee Titans.

Haynesworth entered the plea to the simple assault misdemeanor offense at a hearing in local court. His trial had been scheduled to start on Tuesday.

Haynesworth, who signed a seven-year $100 million contract with the Redskins in February 2009, was sidelined without pay for the team's final four games last year for "conduct detrimental to the club."

Under a no contest plea, the defendant agrees that prosecutors could prove their case beyond a reasonable doubt. The defendant does not contest the facts of the case.

According to a fact statement of the evidence submitted by prosecutors at the hearing, early on February 13, Haynesworth sat with a private party of 15 to 20 people in a cordoned-off lounge section on the rooftop terrace of The W Hotel.

Around 2 a.m., as the server cleared dishes from nearby tables, Haynesworth pulled out a credit card and indicated he was ready to pay the check, prosecutors said.

The server, who was wearing a dress that did not have pockets and who had both hands full of plates, told him that she would quickly put the dishes down. But Haynesworth insisted that she take his credit card immediately.

When she looked down at her full hands, Haynesworth slid the card down the front of her dress, inserting it between her bra and skin, prosecutors said.

He then moved his hand toward her left breast, eventually touching her nipple with the backs of his fingers, they said.

"This resolution requires Mr. Haynesworth to atone for his crime while at the same time honoring the victim's wishes and allowing her to move on with her life," U.S. Attorney Ronald Machen said in a statement.

If Haynesworth complies with all conditions of the agreement, prosecutors will go along with a defense motion to withdraw the plea and will dismiss the case.
